By accessing or using our website, communications, or referral and placement services (the “Services”), you agree to these Terms of Use and the Privacy Policy below. If you do not agree, please discontinue use immediately.

2. Nature of Services

Bespoke Senior Services provides senior housing referral and placement assistance.
We are not a healthcare provider, financial institution, or legal advisor.
Information we provide:

• Is for informational and referral purposes only;

• Does not constitute medical, legal, or financial advice;

• Should not replace consultation with qualified medical, legal, or financial professionals.

3. User Responsibilities

You agree to:

• Provide accurate, current, and complete information;

• Only share information you have the right to disclose;

• Use our Services only for lawful purposes.

4. No Endorsement or Guarantee

Bespoke Senior Services does not own, operate, or control the senior living communities or providers we may refer you to. We do not:

• Guarantee the quality, compliance, or suitability of any provider;

• Verify the accuracy of pricing, availability, or claims made by third parties.

Your interactions and agreements with providers are solely between you and them.

5. Limitation of Liability

To the fullest extent permitted by law:

• No Warranties: Our Services are provided “as is” and “as available.”

• Damages Cap: Our total liability shall not exceed $100.

• No Indirect Damages: We are not liable for indirect, incidental, or consequential damages, even if advised of the possibility.

6. Indemnification

You agree to indemnify, defend, and hold harmless Bespoke Senior Services, its owners, employees, and affiliates from any claims, damages, or expenses (including reasonable attorney fees) arising out of:

• Your use of our Services;

• Information you provide;

• Your dealings with referred providers.

7. Intellectual Property

All materials on our website (text, graphics, design, software, and logos) are owned or licensed by Bespoke Senior Services. No content may be copied, modified, or reused without our written consent.

8. Third-Party Links

Our website may include links to third-party websites. We are not responsible for their content, policies, or practices.

9. Dispute Resolution

• Arbitration: Any dispute shall be resolved through binding arbitration under the American Arbitration Association’s rules.

• Waiver of Jury Trial and Class Action: You waive the right to a jury trial and class action participation.

• Venue & Governing Law: Arbitration will occur in Douglas County, Colorado, under Colorado law.

10. Termination

We may suspend or terminate Services to you if you violate these Terms or misuse the website.

11. Updates to Terms

We may revise these Terms at any time. Updates will be effective upon posting with a new “Effective Date.”

12. Severability

If any provision is found invalid, the remaining sections remain in effect.

Part II: Privacy Policy

• Provide and improve our placement and referral services;

• Comply with legal or regulatory obligations.

We do not sell personal data or share it for cross-context behavioral advertising as defined under the Colorado Privacy Act.

3. How We Share Information

We may share your information with:

• Senior Living Communities to facilitate placement referrals;

• Trusted Partners who support business operations (e.g., hosting, analytics, communication tools);

• Legal Authorities when required by law;

• Business Successors in mergers or transfers.

We may use third-party service providers (such as hosting, email, or analytics vendors) to support our operations. These providers process data only on our behalf, under confidentiality and data protection agreements.

4. Cookies & Tracking

We use cookies and analytics tools to enhance website performance and understand user engagement.
You may disable cookies in your browser, but certain functions may not work properly.

Opt-Out of Tracking:
Colorado residents may opt out of targeted advertising or profiling by disabling cookies in their browser or by enabling a recognized universal opt-out mechanism (such as Global Privacy Control). We will honor valid opt-out signals received through your browser.

• Retention: We retain data as long as needed to fulfill the purpose collected or meet legal requirements.

We do not knowingly collect data from individuals under 18. Any such information will be deleted upon discovery.

8. HIPAA Non-Coverage

Bespoke Senior Services is not a covered entity or business associate under HIPAA.

• Information you provide, even if health-related, is not protected as “PHI.”

• You should share only what is necessary for referral purposes.

• We protect your data under this Privacy Policy, but not under HIPAA standards.

9. No Professional Advice

Our Services and materials are for informational purposes only.
We do not provide:

• Legal advice — consult an attorney;

• Financial advice — consult a financial professional.

We take reasonable precautions but disclaim all warranties regarding data accuracy or completeness. Our liability is limited as described in Section 5 above.
